If you are a buyer or seller of a house or condo in Honolulu, it is prudent to ask a potential broker or agent who may represent you if they maintain Errors and Omissions Insurance (E & O). One of the common myths is that the E & O protects the client (buyer or seller), but it protects them indirectly, since it insures the company against losses it may have resulting from an agent’s failure or fault.
Should you work with a broker that does not maintain E & O? You are free to do so, however, be crystal clear that you are then relying on that broker’s ability alone to cover any potential loss resulting from their error. The answer is a no-brainer, I recommend working with professionals (Doctors, Lawyers, Accountants, etc.) that offer additional protection in the form of additional professional insurance (E & 0 and malpractice).
