Hawaii’s Act 137 Screws Short Selling Sellers

If you need a short sale, Act 137, makes it very hard for a Realtor to help you. Act 137 makes it illegal for an agent that acts as a DPC (Distressed Property Consultant) to be paid a commission. Before you throw a party because you can now save a commission, consider that because of this law many Honolulu agents and brokers will not work on short sales. This will diminish the market exposure for your property, which means that you will get even less for your home.
This law has thrown the Realtor community into a quandary because the law makes many of the things a Realtor does in a distressed property sale come under the purview of a DPC. If a Realtor acts as a DPC and violates the law, the penalty can be as high as three times the sales price of the home. This huge potential penalty is enough to scare off many Realtors. Here is another example of our good intentioned Government screwing things up.
